1. Acceptance of terms
Infrasite and InfraTenders ('InfraTenders' or 'Infrasite.nl' or 'Infrasite.net' or 'Infrasite') are information services from e-Keet.nl. By registering with Infrasite or InfraTenders, you ('the user' or 'user' or 'you') agree to be bound by all of the terms and conditions set forth below.
2. Fees, Payment and Cancellation Policy
Full access to InfraTenders requires payment of fees. Users shall pay all appropriate fees, as described under Membership Options in accordance with the selected subscription model. e-Keet.nl reserves the right to change its fees and/or to institute new charges at any time, with notice posted under Membership Options. Use of InfraTenders by the user following notification shall constitute acceptance of any new or increased charges. Users have 30 days from the date that any discrepancies in the confirmation email of their order first appear to notify e-Keet.nl; after that time all charges will be deemed correct. Subscriptions are automatically renewed for another year. Cancellation can be done ultimately 30 days before renewal. Information about your renewal date can be obtained by sending us an email at subscription@infrasite.net. The information will be sent to the email address connected to that subscription.
3. Accurate information
You will provide accurate and current information on all registration forms on Infrasite or InfraTenders. You will not impersonate any person or entity, misrepresent your affiliation with a person or entity; or misrepresent the origin of any content distributed through Infrasite or InfraTenders.
4. Privacy Policy
Your personal privacy is extremely important to e-Keet.nl ('we', 'us', or 'our'). We have therefore created this Privacy Policy in order to demonstrate our commitment to our users’ privacy and the right of privacy throughout the Internet. Please read this privacy policy to learn more about the ways in which we use and protect your personally identifiable information.
4.1. Overview
The privacy practices of this statement apply to our services available under the domain and subdomains of http://www.infratenders.net, http://www.infrasite.net or http://www.infrasite.nl ('our websites' or 'these websites' or 'websites'). By visiting these websites or registering for them you agree to be bound by the terms and conditions of this Privacy Policy. If you do not agree, please do not use or access our websites.
4.2. Information Collection
Personally Identifiable Information: In general, you can browse our websites without telling us who you are and without revealing any personally identifiable information about yourself. When we ask for personally identifiable information, it is used only in providing the information you have requested. For example, when you register with our websites, you are required to provide some contact information (name, company/organization, email and/or country of residence). Where possible, we indicate which fields are required and which fields are optional. No other personally identifiable information is collected without your consent.
Statistical Data: We collect statistical information based upon your behavior on our websites. We use this information only to do internal research on our users' demographics, interests and behavior, to better understand, protect and serve you and our community. None of this information can identify you as an individual. 4.3. User Profiles
If you decide to store User Profile (s) at InfraTenders, we store those User Profiles on the InfraTenders server. This is done so you can access these User Profiles from any computer, using your personal login codes. These User Profiles are password protected.
4.4. Use and Disclosure of Information.
Personally identifiable information: When you are on an area of our websites and are asked for personally identifiable information during the registration process, you are providing that information to e-Keet.nl.
We use your personally identifiable information to facilitate the information you request (e.g., Newsletter, User Profiles).
As a matter of policy, we do not rent or sell any of your personally identifiable information to any third parties. Due to the existing regulatory environment, we cannot ensure that all of your private communications and other personally identifiable information will never be disclosed in ways not otherwise described in this Privacy Policy. By way of example (without limiting the foregoing), we may be forced to disclose personally identifiable information to the government or third parties under certain circumstances, third parties may unlawfully intercept or access transmissions or private communications. Therefore, although we use industry standard practices to protect your privacy, we do not promise, and you should not expect, that your personally identifiable information or private communications will always remain private.
Statistical data: We are currently using and have contracted StatCounter and Deepmetrix, and third parties, to track and analyze non-personally identifiable usage and volume statistical information from our users to administer our web site in order to constantly improve the web site quality. StatCounter and Deepmetrix will not disclose such information to any third party. StatCounter and Deepmetrix use cookies to help track visitor behavior and sets cookies on behalf of e-Keet.nl. e-Keet.nl reserves the right to publish non-personally identifiable, summary information regarding our visitors and users for promotional purposes and as a representative audience for advertisers. Please note that this is not personally identifiable information, only general summaries of the activities of our visitors and customers and no one will be able to identify or contact you on account of that information.
4.5. Accessing, Reviewing and Changing of Personally Identifiable Information.
We offer you the ability to review and change the information you submit to us by sending us an email with the request of changing or reviewing your information. You must promptly update your personally identifiable information if it changes or is inaccurate. You can deactivate your registration and contact information by sending us an email.
We will retain in our files some personally identifiable information to trouble shoot problems, enforce our Terms and Conditions and comply with legal requirements as is permitted by law. Therefore, you should not expect that all of your personally identifiable information will be completely removed from our databases in response to your requests.
4.6. Other Information Collectors
Except as otherwise expressly included in this Privacy Policy, this document only addresses the use and disclosure of information we collect from you. Our websites contain links to other websites. We are not responsible for the privacy practices or the content of these other websites. To the extent that you disclose your information to other parties, different rules may apply to their use or disclosure of the information you disclose to them. Since e-Keet.nl does not control the privacy policies of third parties, you are subject to the privacy policies of that third party.
4.7. Security
Our websites have stringent security measures in place to prevent the loss, misuse, and alteration of information under our control. Your information is stored on e-Keet.nl’s servers located in The Netherlands. We use procedural and technical safeguards to protect your personally identifiable information against loss or theft as well as unauthorized access and disclosure to protect your privacy.
While we strive to protect your personally identifiable information, no data transmission over the Internet is guaranteed to be 100% secure. Thus, e-Keet.nl cannot ensure or warrant the security of any information during transmission to or from our websites, and you submit information to us at your own risk. However we do our best to ensure the highest level of security on our systems.
4.8. Notice
We may amend this Privacy Policy at any time by posting the amended terms on our websites. Your continued use of these websites following the posting of changes to Privacy Policy will mean that you accept these changes.

5. Login and Password
Access to and use of InfraTenders is through a combination of a User ID ('login') and password. These are connected to your email address. You agree that such access will not be shared with others. You may not access InfraTenders using the login or password of any other party. Users are responsible for maintaining the confidentiality of their login and password. Users shall be responsible for all uses of their login, whether or not they are authorized. Users agree to immediately notify e-Keet.nl (by email subscription@infratenders.net) of any unauthorized use of their login(s) or password(s).
You are responsible for all activities that occur under your password or account. You will immediately notify us of any unauthorized use of your password or account or any other breach of security. You will not disrupt the functioning of Infrasite or InfraTenders, solicit another user's password, or otherwise act in a way that interferes with other users' use of Infrasite or InfraTenders. Nor may you post or distribute any computer program that damages, detrimentally interferes with, surreptitiously intercepts, or expropriates any system, data, or personal information.
6. Objectionable content
The opinions and views expressed by other users of Infrasite or InfraTenders or content providers do not necessarily reflect those of e-Keet.nl, Infrasite or InfraTenders. You waive any claim resulting from your exposure to material on Infrasite or InfraTenders that is offensive, indecent, or otherwise objectionable.
7. License of your content
If you post content in areas available to the general public, you are giving us the world-wide, royalty-free, perpetual, irrevocable, sub-licenseable, and non-exclusive license to use, reproduce, modify, adapt, frame, brand, co-brand, and publish such content in any media now known or later developed, including the right to make the content available to the general public via Infrasite or InfraTenders. If you submit summary files or other materials to Infrasite or InfraTenders, you license us to display, distribute, frame, and link to that content and warrant that you have all rights necessary to authorize the distribution and re-distribution of that content. You will provide information that we reasonably request related to any claim that your content infringes the rights of a third party.
8. Infrasite and InfraTenders
Software and/or content on Infrasite or InfraTenders and any software it incorporates or downloads to you ('Software') contains proprietary and confidential information that is protected by applicable intellectual property and other laws. Except as expressly authorized by us or the owner of such proprietary information, you will not modify, sell, or distribute works based on Infrasite or InfraTenders or the Software. We grant you a personal, non-transferable, and non-exclusive license to use the object code version of the Software; provided that you do not (and do not allow any third party to) copy, modify, reverse engineer, assign or otherwise transfer any right in the Software or content; and you will not modify the Software or the content or access Infrasite or InfraTenders by any means other than the one we provide. Except as otherwise specifically noted in a license agreement, we provide no assistance other than the support available to our registered subscribers, clients and partners.
9. No dealings with advertisers
A number of other companies supply content to Infrasite or InfraTenders and may make offers available to you. You deal with and enter into transactions with advertisers on or suppliers of content to Infrasite or InfraTenders at your own risk. While the Infrasite or InfraTenders trademark will appear on all pages available via Infrasite or InfraTenders to let you know that you are still within the InfraTendering system, we are not a party to any such transactions and are not liable for any claims or damages that may result from them.
10. Links to Infrasite or InfraTenders
If you wish to link from your website to Infrasite or InfraTenders, please send us an email. You are granted a limited, non-exclusive license to create a hypertext link to Infrasite or InfraTenders, provided that the link does not portray Infrasite or InfraTenders, Infrasite or InfraTenders, or Infrasite or InfraTenders's affiliates in a false, misleading, or defamatory way. We may revoke this license at any time. You will not frame any aspect of Infrasite or InfraTenders or any Infrasite or InfraTenders content or trademark.
11. Links to third-party sites
We or third-party providers of content may provide links to other World Wide Web sites or resources. We do not control these sites and resources, do not endorse them, and are not responsible for their availability, content, or delivery of services.
12. Limited Use
You acknowledge and agree that all content and all materials available through Infrasite or InfraTenders are the property of e-Keet.nl or its licensors and may be protected by copyright and other intellectual property laws. Information received through Infrasite or InfraTenders may be displayed, reformatted and printed only to the extent permitted by applicable licenses for use by you or your company or organization as end users, and not for resale. You agree not to reproduce, retransmit, distribute, disseminate, sell, publish, broadcast or circulate the information received through Infrasite or InfraTenders to anyone, outside your company or organization, without the express prior written consent of e-Keet.nl.
Users may not post any content from InfraTenders or Infrasite to newsgroups, mail lists or electronic bulletin boards, without the prior written consent of e-Keet.nl. Systematic retrieval of data or other content from InfraTenders or from Infrasite to create or compile, directly or indirectly, a collection, compilation, database or directory without written permission from e-Keet.nl is prohibited. e-Keet.nl reserves the right to discontinue or change Infrasite or InfraTenders, or its availability to you, at any time without notice.
13. Content, Use, Storage and Operation
We may edit, move, or delete any content on Infrasite or InfraTenders (including content or communications that you have provided) for any reason, and may preserve and disclose content or user information if required to do so by law or in the good faith belief that doing so is necessary to: (a) comply with legal process; (b) enforce these terms, (c) respond to claims that any content violates the rights of third parties; (d) protect the rights, property, or personal safety of Infrasite or InfraTenders, its users, or the public, or (e) administer Infrasite or InfraTenders.
We generally do not pre-screen, monitor, or edit content provided by third parties. We are not responsible for any failure to remove or delay in removing harmful, inaccurate, unlawful, or otherwise objectionable content originating with or otherwise provided by third parties.
We may set limits regarding Infrasite or InfraTenders, including limits on the length of storage of email and other user content, the number of messages going to or from a user account, the size of messages, and the total amount of storage available to a user. We are not liable for the deletion or loss of messages, other communications, or other content maintained or transmitted by Infrasite or InfraTenders.
We may change or terminate Infrasite or InfraTenders or any part of it without notice or liability. We may terminate or change your password, account, or use of all or any part of Infrasite or InfraTenders and may remove any content within Infrasite or InfraTenders without notice and for any reason, including lack of use or violation of these terms.
14. Indemnity
You will indemnify Infrasite or InfraTenders, and its subsidiaries, affiliates, officers, agents, and employees against any claim or demand, including reasonable attorneys' fees, related to content you distribute via Infrasite or InfraTenders or your use of or conduct on Infrasite or InfraTenders.
15. Disclaimer of Warranties and Liability
Due to the number of sources from which information on Infrasite or InfraTenders is obtained, and the inherent hazards of electronic distribution, there may be delays, omissions or inaccuracies in such information and Infrasite or InfraTenders. e-Keet.nl and its affiliates, agents, and licensors provide Infrasite or InfraTenders 'as is, as available' and cannot and do not warrant the accuracy, completeness, currentness, noninfringement, merchantability, or fitness for a particular purpose of the information available through Infrasite or InfraTenders, or Infrasite or InfraTenders itself. neither e-keet.nl, nor any of its affiliates, agents, or licensors shall be liable to users or anyone else for any loss, damage or injury caused in whole or part by its negligence or contingencies beyond its control in procuring, compiling, interpreting, reporting, or delivering infrasite or infratenders and any information through infrasite or infratenders. You use infrasite or infratenders at your own risk, and infrasite or infratenders, its employees, distributors, directors, agents or licensors are not liable for any errors or omissions in its content or delivery, or for any form of loss or damage (including any consequential, indirect, incidental, special, or exemplary damages, even if known to us) that may result from its use. In no event will e-keet.nl, its affiliates, agents, or licensors be liable to users or anyone else for any decision made or action taken by them in reliance on such information or for any consequential, special or similar damages, even if advised of the possibility of such damages. Users agree that the liability of e-keet.nl, its affiliates, agents, and licensors, if any, arising out of any kind of legal claim (whether in contract, tort, or otherwise) in any way connected with infrasite or infratenders or the information in infrasite or infratenders shall not exceed the amount users paid to e-keet.nl for use of Infrasite or InfraTenders.
16. Trademark Information
Our trademarks Infrasite, e-Keet.nl and InfraTenders identify our products and services. You may make fair use of our trademarks in advertising and promotional materials, and in referring to our products and services (for example, in a magazine article) without our permission, provided you follow standard trademark usage practices and provide proper attribution. Other uses require our written permission. Please make such requests by email to legal@infrasite.net.
You may never use our trademarks in the following ways:
· In a non-Infrasite or InfraTenders product name or publication title.
· In, as, or as part of your own trademarks.
· To identify products or services that are not Infrasite or InfraTenders's.
· To cause confusion.
· To suggest inaccurately that we sponsor, endorse, or are otherwise connected with your activities, products, or services.
· To disparage Infrasite or InfraTenders.
· In any other manner that Infrasite or InfraTenders or its users find offensive.
When you use our trademarks, please include the following attribution:
Infrasite or InfraTenders and the logos are registered trademarks of e-Keet.nl in The Netherlands and other countries.
Except as noted above, you may not use, copy, or redistribute Infrasite or InfraTenders logos without written or electronic permission from Infrasite or InfraTenders. If you do not have a pre-existing agreement with Infrasite or InfraTenders, you may request permission for logo use, but such permission is granted only infrequently. Send your request for permission to use a Infrasite or InfraTenders logo to legal@infrasite.net, with "Infrasite or InfraTenders Logo Request" in the subject line. Please include a description of your company, which logo you want to use, why and how you want to use it, and a mockup showing the proposed use.
17. Copyright information
We own intellectual property and/or license rights to the content on Infrasite or InfraTenders and its design, structure, and compilation (sometimes known as 'look and feel'). It is very easy to copy things in cyberspace, but not necessarily always acceptable or legal. You must have the legal right to any content you upload or download using Infrasite or InfraTenders. Unless otherwise noted, you may view, copy, download, and print Infrasite or InfraTenders documents from Infrasite or InfraTenders so long as you use them only for personal, non-commercial purposes as an end-user and do not post, distribute, or modify them or remove any copyright, trademark, or other proprietary notices. For permission to use third-party materials appearing on Infrasite or InfraTenders, please contact the copyright owner.
18. Claims of copyright infringement
If you believe that your work has been copied and is accessible on Infrasite or InfraTenders in a way that constitutes copyright infringement, please contact us at legal@infrasite.net.
19. Changes in terms and conditions and acceptance of these changes
e-Keet.nl may change the terms in this Agreement without notice to you. When the terms are changed, the changes will appear in this document. By using Infrasite or InfraTenders after any change in the Agreement is posted, you agree to be bound by all of the changes as well. You should consult this page each time you access Infrasite or InfraTenders.
20. General terms
This Agreement is personal to you, and you may not assign your rights or obligations to anyone. If any provision of this Agreement is invalid under applicable law, the remaining provisions will continue in full force and effect. This Agreement constitutes the entire agreement between you and Infrasite or InfraTenders and governs your use of Infrasite or InfraTenders, superseding any prior agreements. Additional or different terms and conditions may apply when you use affiliated websites, third-party content, or third-party software. Interpretations of the Agreement and determinations that you have breached the Agreement will be made at our reasonable discretion and based on facts known to us. The laws of The Netherlands govern this Agreement and our relationship. You agree to submit to the personal and exclusive jurisdiction of the courts located in 's-Hertogenbosch for any claim or dispute with Infrasite or InfraTenders or any of its subsidiaries, affiliates, officers, agents, licensors or employees. Our failure to enforce any right under this Agreement will not waive that right. If any provision of this Agreement is invalid, the Agreement should be interpreted to effect the intent of the parties, and the remaining provisions will remain in effect. You must file any claim or suit related to Infrasite or InfraTenders within one year after it arises. The section titles in this Agreement are for convenience only and have no substantive effect.
